General Conditions of Sale

The Customer who purchases on the site declares that he is legally capable of committing to these general conditions of sale.

All prices shown on the site are inclusive of all taxes. Product prices are indicated in euros. Una Stell reserves the right to change its prices without notice and the prices applied to the Customer correspond to those displayed on the site at the time of the order. The goods remain the full property of Una Stell until receipt of the total amount due paid by the Customer.

Una Stell strives to present and describe its items as accurately and accurately as possible.

The order is validated once the payment has been accepted by Una Stell. Una Stell reserves the right to refuse an order if the Customer already has a dispute with Una Stell or if Una Stell considers that the Customer poses a risk of default of payment. Una Stell then reserves the right to ask its Customer for additional information if it deems it necessary, such as an identity document or proof of address. If the Customer does not respond within 5 days of the order, the order and payment are cancelled. Una Stell undertakes to honour the orders received, only within the limit of available stocks.

Any order placed before 2 p.m. is shipped the same day, except for orders placed on Saturday and Sunday which will be shipped the following Monday, as well as orders placed on public holidays which will be shipped the following working day.

The Customer has the choice between several delivery methods: Colissimo, Chronopost.

Any order placed before 2 p.m. is shipped the same day, except for orders placed on Saturday and Sunday which will be shipped the following Monday, as well as orders placed on public holidays which will be shipped the following working day.

Delivery outside Metropolitan France is made by IMX or Fedex depending on the destination.

Outside the European Union, customs or import taxes may be added to the price of our products and remain the responsibility of the Customer. It is therefore the Customer's responsibility to inquire about their amount at their local customs office.

Shipping costs are the responsibility of the Customer and vary depending on the destination: all details of costs and times by geographic area can be found on the Deliveries & Returns page.

Once the Customer validates his order, he accepts all of the General Conditions of Sale. The Customer pays on the site https://la-stella.fr:

- by bank card (CB, Visa or Mastercard) via the secure Stripe payment platform; and/or

- by means of a voucher.

Your order may be subject to 3D Secure verification. 3D Secure is an authentication payment system that guarantees you optimal security when shopping online. When paying, your bank verifies the identity of the cardholder before validating the transaction.

How a 3D Secure verification works
After validating your bank details, you are transferred to your bank's website. In the 3D Secure window that appears, the authentication process to follow is specific to each bank. You may be asked:
• Enter your date of birth
• To enter a code received by SMS
• Or even to answer a personal question.
This exchange of information between you and your bank is secure. It guarantees the identity of the card user. For any questions about the 3D Secure code (obtaining, losing, changing, etc.), contact your bank directly.

ATTENTION: After 3 authentication failures, your transaction is cancelled. Your card will be blocked. Then contact your bank. For any questions you can also contact our customer service at 06 13 58 08 99.

In order to protect itself against certain abusive practices by fraudsters, UNA STELL checks the orders that have been validated on its site. As part of this check, our customer service may be required to ask you for certain documents useful for validating your order, including proof of address in your name, or in the name of the person indicated for the delivery address, etc.

Una Stell entrusts the security of its transactions to the Stripe service provider. Payment is secured thanks to the online payment system of our partner Stripe. Banking data only circulates on the Internet in encrypted form, that is to say, it is coded in such a way as to make it completely illegible and is therefore never kept by Una Stell.

All personal data communicated by the Customer on the site https://la-stella.fr are subject to computer processing intended for the processing and delivery of orders, the choice of samples offered and the suggestion of products adapted to the needs of the Customer. This data is exclusively reserved for Una Stell.

In accordance with the French Data Protection Act No. 78-17 of 6 January 1978, as amended, the processing of the Client's personal data is subject to a declaration to the CNIL and the Client has the right to access, modify, rectify and delete data concerning him/her by contacting Una Stell, 3 rue du Verger, 38700 Corenc – una.stell@free.fr

The Customer can subscribe to the La Stella newsletter and thus choose to be regularly informed of the offers proposed. He has, at any time, the possibility to unsubscribe by clicking on the link provided for this purpose on each of the newsletters.

The Customer has a period of 14 days from the day of receipt of his order to exercise his right of withdrawal without giving any reason.

To exercise the right of withdrawal, the Customer must notify Una Stell (3 rue du Verger, 38700 Corenc – una.stell@free.fr) of their decision to withdraw before the expiry of the deadline by means of an unambiguous declaration (for example, letter sent by post or email).

In the event of withdrawal by the Customer, Una Stell will reimburse the amount of the order, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen, where applicable, a more expensive delivery method than the standard delivery method offered by Una Stell) no later than fourteen days from the day on which Una Stell is informed of the Customer's decision to withdraw.

Una Stell may defer reimbursement until receipt of the returned products or until the Customer has provided proof of shipment of the products, whichever is the earliest.

When the order was accompanied by a gift offered to the Customer under conditions – for example, a gift offered only if a minimum order amount was reached – and the Customer no longer meets the conditions necessary to obtain the gift due to the Customer exercising the right of withdrawal, the gift must be returned to Una Stell with the returned products and Una Stell may defer the refund until receipt of the gift or until the Customer has provided proof of shipment of the gift, the date retained being that of the first of these facts.

Una Stell will make the reimbursement using the same means of payment as that used for the initial transaction, unless the Customer expressly agrees to a different means and this reimbursement does not incur any costs for the Customer.

The Customer must return or hand over the goods to the address 3 rue du Verger 38700 Corenc, for La Stella, no later than fourteen days after the Customer has communicated his decision to withdraw. This deadline is deemed to have been met if the Customer returns the goods before the expiry of the fourteen-day period.

The Customer will have to bear the direct costs of returning the goods.

Una Stell advises the Customer to choose a mode of transport with a tracking number. Without a tracking number, Una Stell will not accept any claims.

The Customer is only liable for any depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

Orders placed on the La Stella website cannot be returned or exchanged in stores.

Vouchers sent by Una Stell in exchange for a return or purchased by the Customer can be used for 1 year on all products offered on the site https://la-stella.fr. Vouchers cannot be combined with each other or with promotional codes. Gift vouchers purchased on the La Stella website cannot be refunded in cash.

Promotional codes only apply to non-discounted base prices. Promotional codes cannot be combined with each other or with vouchers. Promotional codes can be used once per Customer account unless otherwise instructed by Una Stell. These codes are not refundable upon exchange.

All elements present on the site https://la-stella.fr, whether visual, textual or audio, are the exclusive property of Una Stell, or of the holder of the intellectual property rights concerned, and are as such protected by the intellectual property code and copyright. As such, any reproduction of the La Stella brand or the site https://la-stella.fr, partial or complete, is strictly prohibited.

You may link to our website, provided you do so in a way that is fair and does not damage our reputation or take advantage of our goodwill. However, you must not establish a link in such a way as to suggest any form of association where none exists. Furthermore, you must not establish a link to our site from any website that is not owned by you. We reserve the right to remove links without notice.

Una Stell shall not be liable to third parties for indirect damages, special damages or incidents resulting from negligence, failure or clumsiness of the Customer, or resulting from improper use by the Customer of one of the products offered for sale on the site https://la-stella.fr. Concerning access to the site, consultation of the latter, the ordering process, payment of delivery and service, Una Stell has only an obligation of means.

Una Stell cannot be held liable for any inconvenience or damage inherent to the Internet network, in particular any disruption to the connection or any intrusion of a computer virus.

In addition, Una Stell is exempt from any liability for any event qualified as force majeure within the meaning of the case law of the Court of Cassation. Finally, Una Stell's liability is limited to the amount of the Customer's order.

The products sold on the site https://la-stella.fr are subject to the legal guarantee of conformity set out in articles L.217-4 et seq. of the Consumer Code and to the guarantee against hidden defects set out in articles 1641 et seq. of the Civil Code.

Article L. 217-4 of the Consumer Code: The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been placed at his expense by the contract or has been carried out under his responsibility.

Article L. 217-5 of the Consumer Code: The good complies with the contract: 1° If it is suitable for the use usually expected of a similar good and, where applicable: - if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model; - if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling; 2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L. 217-12 of the Consumer Code: The action resulting from the lack of conformity is prescribed by two years from the delivery of the good.

Article 1641 of the Civil Code: The Seller is bound by the guarantee for hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.

Article 1648 of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.

When acting under the legal guarantee of conformity, the Customer:

- has a period of two years from delivery of the goods to take action;
- may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

The Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and may in this case choose between the resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

The Customer fully accepts and acknowledges that French law governs these General Terms and Conditions of Sale, as well as any dispute or litigation that may arise between the Customer and the company Una Stell. In addition, the Internet user (or the Customer) accepts that in the event of a dispute, following a visit or a purchase on https://la-stella,fr, the French courts are recognized as competent.

a. Order: When you place an order, we are required to record your data in order to best process your order and to ship the products purchased. This information is also kept for security purposes, to comply with legal and regulatory obligations, and to enable us to improve and personalize our offers. Thanks to your email address, we will be able to send you an order confirmation and communicate with you if necessary. 5. THE SERVICE – MYSTELLAFLAPS SUBSCRIPTIONS

We offer 2 subscription offers for Star flaps or Baby flaps allowing you to discover all our interchangeable flaps at a preferential price on current collections (excluding capsule or archive collections).
• a quarterly subscription for a period of 12 months, the subscription is non-cancellable, non-modifiable and renewable only by taking out a new subscription.

The subscription will expire on the anniversary date of the issue. Any rebates not ordered within the subscription period will be forfeited and cannot be refunded, exchanged or compensated in the form of credit, cash, gift cards or other monetary values.

6. ACCESSIBILITY OF SERVICES

The Subscription Services subscribed to by the buyer on the Site will be accessible only in mainland France, Corsica and Monaco. Any subscriptions outside these areas will not be taken into account.
The Site is in principle accessible 24/7, except for interruptions, scheduled or not, for maintenance purposes or in cases of force majeure. Being in fact subject to an obligation of means, the company Unastell (operating under the trade name La Stella) cannot be held responsible for any damage, whatever its nature, resulting from unavailability of the Site.

7. WARRANTIES

By subscribing to our Services on our Site you guarantee that you meet all of the following criteria:
a. you are legally authorized to enter into contracts, and more generally legal acts that bind you;
b. you are at least 18 years old;
c. you are a permanent resident in France;
d. you access our Site from that country;
e. you have the skills, hardware and software required to use the Internet and are fully aware of and assume responsibility for the characteristics of the Internet and its use, in particular the limitations related to technical performance, response times and the risks related to the security of communications. Consequently, the company Unstell (trading under the trade name La Stella) does not guarantee that the Site will be free from anomalies, errors or bugs, nor that the Site will operate without breakdown or interruption. In this respect, it may freely determine any period of unavailability of the Site or any of its sections, for technical reasons, to improve its content or to optimize its use.

FORMATION AND TERMINATION OF THE SUBSCRIPTION CONTRACT CONCLUDED BETWEEN YOU AND THE COMPANY UNASTELL (EXERCISING UNDER THE TRADE NAME LA STELLA)

The contract between you and Unastell (trading under the trade name La Stella) hereinafter referred to as the "Contract" will be concluded upon your validation of the subscription made by completing our standard form. After subscribing to the subscription, you will receive a subscription confirmation email with payment details (hereinafter referred to as the "billing email"). The order constitutes acceptance of the General Terms and Conditions. Unless proven otherwise, the data recorded by the company Unastell (trading under the trade name La Stella) constitutes proof of all past transactions. You must check the completeness and conformity of the information provided to the company Unastell (trading under the trade name La Stella) when subscribing. Unastell (trading under the trade name La Stella) cannot be held responsible for any data entry errors and the consequences resulting from them.

The Contract covers the Services that are the subject of a billing email and/or a shipping confirmation. By subscribing to one of these subscriptions, you acknowledge that your membership will result in a mandatory recurring payment and assume all of these costs until the end of the subscription. You can change your payment method at any time by logging into your account or by sending an email to hello@la-stella.fr. The company Unastell (trading under the trade name La Stella) reserves the right to terminate the subscription at any time or to suspend the subscription in the event that a delivery cannot be made.

By subscribing to the aforementioned MYLASTELLAFLAPS subscriptions, you agree to pay each month the flat-rate fee indicated on the Site including the costs corresponding to the delivery costs of the products during the chosen duration. By subscribing to the fixed-term MYSTELLAFLAPS subscriptions, you agree to pay the full amount covering the subscription period chosen at the time of ordering. No refund may be offered, apart from that provided for within the framework of the withdrawal period explained.

8. RIGHT OF WITHDRAWAL

The buyer has a period of fourteen (14) calendar days, from the day of conclusion of the Contract, to cancel the Contract and return, at his expense, the first deposit received as part of the Services. If the above conditions are met, the company Unastell (trading under the trade name La Stella) will reimburse the buyer for the amounts paid in accordance with the aforementioned article of these General Terms and Conditions.
